Groundhogs Lawn Care. This is the agreement your signature accepts, per New York State and DEC requirements.

1. Agreement and season

The quote, service details, and these Terms form the agreement for the current season. The quote controls the property address, services selected, application count, date windows, and price.

2. Service dates and legal notices

Services are weather, route, safety, and label dependent. The estimate will list approximate application windows. Customer may request specific application dates. If a pesticide application date/window must change, Groundhogs will provide notice and obtain acceptance when required before applying pesticides. Product information, label warnings, SDS/labels, and specific pesticide notices will be provided electronically unless customer requests paper.

3. Payment

Pay-as-you-go customers authorize Groundhogs to charge their payment method on file up to 7 days before each scheduled service. Pay-in-full customers pay at acceptance. Approved add-ons may be charged when approved. Failed payments may pause service. Returned ACH payments or improper chargebacks may result in a $30 returned-payment fee.

4. Access and rescheduling

Customer must provide safe access to the property, including unlocked gates, secured pets, and sprinklers turned off during service windows. If service cannot be completed because access is blocked or unsafe, a $30 trip/rescheduling fee may apply. Customer may reschedule without fee by giving at least 3 days' notice.

5. Cancellation

Customer may cancel by email, or phone. Cancellation stops future services after Groundhogs receives the request, except for services already completed, already dispatched, or scheduled too close to reasonably remove from the route. Customer remains responsible for completed services, approved add-ons, applicable trip fees, and disclosed non-refundable special-order materials purchased specifically for the property. Pay-in-full refunds are prorated based on standard per-visit pricing for completed services.

6. Annual renewal

Groundhogs may send a renewal offer each year. No pesticide services or charges for a new season will begin until the customer accepts that season's renewal summary. Renewal pricing may change and will be disclosed before acceptance.

7. Safety and post-service instructions

Customer must follow all pre-service and post-service instructions, including re-entry directions, watering/mowing guidance, and label-based safety instructions. People and pets must stay off treated areas until allowed by the product label or Groundhogs' written instructions. Pesticide notification signs must not be removed for at least 24 hours. NYCRR requires pesticide markers to include "do not remove sign for 24 hours" and remain posted at least 24 hours after application.

8. Customer responsibilities

Customer must disclose (with confirmation) sensitive areas, hazards, irrigation issues, recent seeding/sod, prior chemical applications, vegetable gardens, wells, ponds, pollinator areas, invisible fences, irrigation lines, low-voltage lighting, drainage, septic components, and any other hidden or shallow items. Customer must clearly mark hidden items before service. Groundhogs is not responsible for damage to unmarked, mismarked, hidden, shallow, or undisclosed items, except to the extent caused by Groundhogs' negligence or misconduct.

9. Results and expectations

Groundhogs will perform services in a professional manner and according to applicable labels and laws. Lawn results depend on weather, soil, watering, mowing, shade, traffic, pests, disease, prior treatments, third-party work, and other conditions outside Groundhogs' control. No specific appearance, 100% weed-free result, pest-free result (except grubs), disease-free result, or "golf course" lawn is guaranteed. Mosquito, tick, weed, and insect services are reduction/suppression services, not total elimination services.

10. Claims and remedies

Customer must notify Groundhogs within 3 business days after discovering a suspected service issue or property damage and must allow reasonable inspection before repairs or third-party work. For direct property damage proven to be caused by Groundhogs, customer's remedy is, at Groundhogs' option, re-performance, repair/replacement of the directly affected area, or refund of the affected service visit. Groundhogs is not liable for indirect, incidental, special, punitive, or consequential damages. Nothing limits liability where prohibited by law, including gross negligence or willful misconduct.

11. Photos and documentation

Groundhogs may photograph or record exterior service areas and content for marketing, social media, documentation, training, quality control, regulatory, and claim purposes. Non-identifying exterior photos and videos may be used for marketing unless customer opts out in writing.

12. Mutual respect and termination

Groundhogs will treat customers and properties with professionalism and respect. Customer agrees to do the same. Groundhogs may suspend or terminate service for abusive, threatening, discriminatory, unsafe, or unreasonable conduct or site conditions. Customer remains responsible for amounts owed for services performed and unavoidable disclosed costs.

13. Entire agreement

This agreement replaces prior discussions about the selected services. Changes must be accepted in writing or electronically.
